Legal Custody

Physical Custody
This determines where the child lives day-to-day and the visitation schedule. It can be given to one parent (sole physical custody) or shared by both parents (joint physical custody).
These two components, legal and physical custody, are essential aspects of determining how parental responsibilities are divided in child custody cases in New York State.
Custody arrangements vary based on the parents’ situation and what’s best for the child, as decided by the court. The court looks at factors like the child’s age, relationships with the parents, and how well the parents can work together when making custody decisions.
